Rural Protect Case Study: Negotiations over firearms licence

Here, we explain the role Rural Protect played in representing the insured at their appeal hearing following a revoked firearms licence case.

Business type: Equine Stud

Section of cover: Personal Liability

Applicable cover: Claims Against an Insured Person

Circumstance: Defence appeals against the decision to refuse firearms renewal.

Legal fees value: £13,015

The scenario:

The policyholder, the defendant in this case, failed to comply with firearms regulations when they didn’t declare information relating to a matter that they were involved in previously, which was contrary to the conditions of applying for a firearm licence, resulting in the police refusing to renew their certificate.

What happened?

Due to the nature of the business, the insured requires a firearm licence to possess shotguns as they run an equine stud and need to be able to euthanise animals in an emergency if they are fatally injured. The business also hosts shoot-related events as they have a country venue for hire.

The outcome:

Rural Protect assisted in negotiations with the police for the certificate to be reinstated. The court’s appeal hearing was averted as rradar were able to resolve the issue with successful negotiations, resulting in the individual receiving their firearms certificate back.

Things to consider:

Court hearings that are held due to issues raised by the police can result in high legal fees. As Rural Protect provides Personal Liability cover (also known as Directors & Officers cover), it means when a third party brings a claim against an individual in the business the costs you would incur, such as legal costs, awards and settlements, would be covered up to the chosen limit of indemnity, which starts from £250,000 for policies incepting or renewing from 1st January 2024.
