The scenario:
The client, an agricultural business, purchased a machine under a hire agreement at a total cost of about £30,000.
The client was told it was cheaper to enter into a three-year agreement, which they could terminate at any stage.
What happened?
They experienced numerous problems with the machine, most of which they repaired themselves. However, two years into the hire period, the machine was taken away by the hire company to repair and return.
Due to the problems experienced, the client didn’t want the machine back.
The client received a letter from the hire company’s solicitor requesting payment of nearly £11,000 for the remaining period of contract within seven days or court proceedings would be started.

The outcome
After a period of negotiations, the case was settled before the final hearing for just £7,000, a significant saving for the client.
