The scenario:
The equine stud business sold a horse to the interested buyer who later on had to euthanise the horse due to a medical issue.
What happened?
Due to the loss of both their money and the horse, the buyer sought to bring a claim against the business, alleging that the horse was defective at the time of purchase and seeking a refund of the purchase price plus other losses that they have had to bear as a result of the horse being euthanised. The buyer also demanded the horse’s veterinary reports which the business would have had a record of prior to selling the horse.
